If this actually what happened, I think he should have used better judgement and just let the dirty fucker suffer, and bleed out.

Although I agree for slighty different reasons.......

Aren't we "supposed" to be better than that?

After the insurgent was disarmed it was determined that his wounds were "too severe for any type of treatment" in the field, court was told.

So what was the soldier's mind set when he did this?

Compassion - he's dying so might as well relieve his suffering
    Revenge
    Anger

    ...something else. :?

It's not murder but assisted suicide.
He violated the standing orders out of compassion and not sadism or cruelty and it would be a huge waste to see this mans career gone because of this.

This would be all but guaranteed an adrenaline reaction if it followed a battle. Im not even sure I wouldnt do the same.

    Its still wrong.

    Tough case.

If it was an animal, we all would have applauded him for ending the misery. But euthanasia is not allowed, THUS it is murder... Tough...

Although I don't want to disagree, RR, I can't help but wonder.
That may be his defense, but we may never know the truth because the Capt. is the only one that knows and he may not tell.

He may not be charged with the first 2 offenses but I think that "behaving in a disgraceful manner, and of negligently performing a military duty" will surely stick.

It's sad though that his career may be lost.

Definately argue, expecially when you have a good or unique perspective.

Your right and it definately could have been anger or revenge also.
I'm more pissed that something like this made it this far up the chain. I have to assume that his superiors felt that it was murder or were afraid they might be caught actually being leaders. The first reeks of idealism and the second reeks of bureaucracy.

Should of...would of... could of. Yeah! he should have known better (to get caught)...would have left this "wounded, unarmed Taliban insurgent" to be fixed up to fight another day (if our politicians were involved)...could prevented him from killing again...Oh! He did (save the lives of future soldiers). Lets pray his Judge/Jury have been in battle.

Officer + Club Ed= Career Ender

In addition to second-degree murder, Semrau is charged with attempt to commit murder. Under the National Defence Act, he also faces charges of behaving in a disgraceful manner, and of negligently performing a military duty.

My understanding is the Charge with attempt to commit murder is a fall back for conviction. Find you guilty of one or the other.

There's is not one soul in this world fit to judge his actions except for a group of his peers, ie; other soldiers who have been in combat.

The way I see it, if the Capt. was a true bastard, he would have left him to suffer and die a prolonged, misery filled death. If this had been a perfectly healthy or lightly wounded taliban, I could see the "uproar" over it, not that I'd have an issue with it.
I notice that so far, no one has contradicted the Capt's assessment of the wounds.

If this was a case of straight walking up and shooting this guy then he was wrong. However, I find that very unlikely. I'll wait for the press release to hear more about that. More likely then not thought, had this Moor Kwas been turned over for first aid he would of been sent to a Jail somewhere.

That's EXACTLY what I would have done, they had to get the fuck out of there before the rest of the Hawji's showed up, not wait around and hold his filthy fucking hand while he expired.
