I think you might be simplifying the whole hate crime sentencing provisions. The purpose of the sentencing provisions was to have Canada recognize that while punching somebody out of anger is bad, punching somebody out of hate for their identity sends a chill out to others who are also of that identity.
It doesn't necessarily mean that "punch a gay guy spend 6 years in jail" is going to happen just because the victim is gay. But, if the assaulter spent time tracking the victim over a series of weeks because the victim kissed another man at a train station goodbye, lured him into an alleyway and then proceeded to yell about the wrath of God being brought down on sinners before smashing in his teeth with one solid blow, don't you think that might be a bit more deserving of jail time than a guy who punches another guy for staring at his girl at the bar?
Each example ends with a pop in the mouth, but one is a much more sinister crime. Also, a Judge is free to hand down sentences as he sees fit given the particular circumstances of each crime. Hate crime sentencing provisions provide
opportunity for a Judge to increase sentence length, not a
requirement.
