Was the sentencing based on name and cultural background? I'll bet if it was John Smith he would be facing just a little harsher sentence. :roll:

A pathologist testified at his preliminary inquiry that the two slaps Sidime delivered to Noutene�s face did not leave a mark. But the slaps caused her head to move in such a violent motion an artery in her head ruptured and oxygen was cut off to her brain. She died in hospital two days later.

A Woman in Vanderhoof got 2 years house arrest for stabbing her lover in the groin and watching him bleed out without getting help. A native woman got 3 years probation for stabbing her partner to death because of her native ancestry and because she was drunk at the time and was now in rehab. So this is nothing new - at least this guy had no intention of killing his daughter.

He also got 2 years of probation.

Comparing cases is ludicrous. We see the sentence, but not the evidence.
And FN Peoples have certain rights as defined by the SCoC.

He also left no marks on her - it may have been that the way she moved her head is what caused the artery to rupture, rather than him hitting her with so much force.

As I said above, this guy didn't mean to kill her and the anguish he will feel for the rest of his life is going to be far greater than any prison sentence. Compare that to the cases I mentioned where the women definitely meant to do serious harm, with death a foreseeable outcome, and didn't spend a day in jail.

I just wish they'd focus much less on "intent" and much more on "result."

Can't agree there. THe law is based on intent. Mens Rea. I don't want this guy to get life while somebody who just beats the shit out of somebody causing brain damage, say, gets a few years because they didn't kill anybody.

Justice is Blind but, apparently in Canada it's also become mentally handicapped. 8O

We've become such an enlightened society that we apparently don't need any archaic hindrances from the past like basing sentences on the crimes committed. All we need now to ensure justice is carried out is a quick review of a persons, age, race, culture and future family references. No muss, no fuss, no unsightly punishments that could hurt our chances of overtaking Disneyland as the Happiest Place on Earth. ROTFL

After rulings like this I can see why the Canadian Judiciary doesn't want to follow Government sentencing guidelines. It'd make people accountable for their actions, which apparently isn't a Canadian value anymore. :roll:
