Slander is defamation spoken and heard.

Thanks, I got it now. If they go to court they don't have much of a case then. MacDonald's claim can be shown to be fact.

It probably doesn't matter. When you read the whole affidavit they're just doing that "Boo hoo, me such a victim", taggiya thing, right now. Basically they're just rubbing the imaginary tears from their eyes, pointing at MacDonald and demanding mamma spank. They haven't actually sued yet.
