Actually, yes. In both Canada and the USA this would be a tort for actual damages and the owner(s) of the dog(s) would be severally responsible for the actions of their dog(s).


I think a clever lawyer would be able to get the civil suit reduced by the "value" of the pet.


An equally clever lawyer would show up in court to counter that move with the Golden Retriever he picked up at a shelter for free. :wink:

It's good to know because you seriously don't want to buy your beef from a farmer. Old dairy cows might make lousy hamburger but that's about all.

Funny you should mention that. I was in the bar the other day when a dog walked in wiht it's arm in a sling. He said, "I'm looking for the man that shot my paw."

Correction.

Some people should not have pets. This family appears to be amoung those.

Obivously the farmer cared more for his livestock than the Jenkin's family cared for their dogs.

Whyizit, I wonder, so many people, 'city folks as well as rural/country folks, reponsible pet owners all, think that it is 'ok' to allow their pets, dogs and cats,( the ones they claim to love so much) run at large? To shit in other peoples yards, tear up their garbage, chase livestock, chase people etc.???

Maybe someone, there has to be at least one person here who fits the above description, can 'enlighten me'!

well in our case the new-ish neighbour in our neighbourhood (moved in around two years ago) has been fueding with the people next door (who have lived here for the better part of ten years) for making to much noise. so they dug up some obscure noise by-law that no one has used since the 70's. This forced the regional district to hire some people for the position because of a bylaw in Fanny Bay that most people didn't even know exist, to go out and test the mans tractor. The thing was within all noise restriction. As such, our next door neighbour decided it was revenge time as started shining a spotlight into the other ones living room and bedroom windows all night long, since busting out the noise-reduction bylaw didn't work.

Anyways, since that time, our neighbours have grown to appreciate our frequent dog-escapes and horse escapes from our property, because they make a mess of his. :D Horses destroy the septic system, dogs shit and drop bones on the lawn (the 10 year neighbour gives bones to his dog, who gives them to buddy, who drops them on the guy's front lawn).

well, I guess everyone but the next-door neighbour likes the escape. hell, even the people who have only lived here for a month like our dog's frequent visits. Their kids love em. They also chase to bears and cougars away whenever they stroll through the neighbourhood, which leads to protection for other peoples cows, children, and our horses.

Any thought the family came from a rural neighbourhood such as ours? and was sued to their dogs coming back after 5-10 minutes?

Yeah well here in Ontario, the federation of agriculture managed to influence a "Right to farm law". This came after a maritime hog farmer had gradually been surrounded by rurbanites who sought, on the grounds of offensive smells, an injunction against the hog farmer and got it from a PC judge, forcing the farmer to shut down his multi-generation hog farm. The injunction was dismissed on appeal.....the the flag went up nation-wide.

It is not unusual, for recent occupants to summon Police when a farmer, customarily conducts his planting/harvest operations at night. Vandalism is frequent, the newcomers think this is justified and really whine when apprehended.

Resenting harvesting operations which disburb their tranquility, all too frequently, these rurbanites have shot at the machines, hurled rocks and vandalized equipment including arson......they feel justified when the Police don't do their bidding.

The farmer was well within his rights to shoot the dogs if he felt they presented a threat to the animals under his care. I am sure that anyother farmer including myself would not have thought about it twice before giving those two dogs a winchester retirement plan.
