A courtroom has VERY specific rules of decorum and when court is in session, for all intents and purposes, that courthouse is the judge's house. Besides, I don't believe all judges are like that so I won't be doing that anytime soon. But, to take your example a step further, I can say those same words to any judge I bump into outside of a courthouse and there is FUCK all he can do about it. Now, I'm not saying the driver that shot the cop the finger was smart for doing it, and I sure as hell don't recommend it, but the ticket will get tossed by the judge and the court's time will have been wasted by this petty act of revenge on the part of the officer.

even a free expression can be considered an incorrect hand signal if the driver was stupid enough to express himself at the wrong time.

That was a stupid move. I would never do that. They are officers of the law. We are not in a police state but we have to behave correctly with them. The guy was driving 35kph up the limit. He knows he is in fault. I'm pretty sure there's a fine like "obstruction of justice" something like that for those kind of manners. He tried, he failed. That's it.

The speeding ticket was for the original infraction which he WELL deserved. The bullshit about whether the second ticket is valid will still be a waste of time. And did anyone stop to think that while she was handing out this petty little piece of revenge, there may have been other speeders she was missing? One could ALMOST call it dereliction of duty. She was there to bust bad drivers, not rude ones.

If he had got away with it would have done the same or something similar or worse to the next cop he had interaction with. Now he will think twice. It's called 'attitude adjustment' and a bad attitude ignored just makes it worse for the next cop the knobhead meets. It's still a lame ticket though. I'm sure there would have been something better to write him up for on closer inspection of his vehicle.

Actually, some people really don't get the point when they get a ticket. I gotta tell you this one cuz it made me howl when I saw it. I was coming back to Ontario on the NY thruway. As I was driving I noticed a guy with Ontario plates pulled over(judging by the car my guess was speeding). About 5 minutes after I passed by, he passed me. Actually he flew by me. Maybe 10 minutes down the road at MOST, there he was again, pulled over for speeding. Even tho he was a Canadian I still had to laugh my ass off at his absolute stupidity. 2 speeding tickets in 15-20 minutes. That's gotta be a record LOL

But most people are pretty respectful if they are treated fairly when pulled over for it. This guy wasn't respectful and he was dealt with accordingly. Still, I find it highly unlikely that he will get a conviction for 'improper hand signal' but it may make some other anti-social cop-hater think twice before doing something similar. That in itself was worth the controversy.

Oh I agree, and once again, I never said I condoned his action, but under freedom of speech and expression, he was free to express how he felt about the ticket. Whether he deserved the speeding ticket isn't really the point.
I also don't think when it gets thrown out, it's going to deter anyone else, with the same mentality, from doing something similar.
My fear is, that this will get bigger and the whole finger thing will end up getting challenged in higher and higher courts. Probably won't happen, but dumber things than that have made their way into the higher courts. For example, the expression 'Fuck off' pretty much means the same as get lost. The term 'Fuck you' however could be interpreted as verbal assault or a threat. Then, it'll come down to what exactly does 'giving the finger' mean, yadda yadda yadda

Then, it'll come down to what exactly does 'giving the finger' mean, yadda yadda yadda Well, I agree with your sentiment but this is a Provincial Offence and if it gets tossed at POA court I can't see a Provincial Crown appealing the JP's decision. And really, this is a 'throw away' ticket. JP's know that if an accused get's more than one ticket for no good reason, he was just being a knob with the cops and the 'attitude adjustment' charges will just get withdrawn, especially if this accused cops a plea to 3 points instead of the 4 that 35 kph over is.

I agree that the 1 finger charge would be tossed out. But the judge should give him a severe tongue lashing in court. Ideally, the press should be there, print the story with his name, photo and the court ruling. I'm sure that the cops will be REAL NICE to him if he ever gets pulled over again.
