HE is making big money because he's had years to get where he is today. Years of training, schooling, and experience.

Well not true in all cases and even if so, you can go do the same now cant you?. Or did they not have these things called books that you can read right at home, kids or not, or the many home schooling courses that can be taken at home in spare time. Dont act like your so busy with kids you couldnt possibley have got some learning done on your own.

lily lily:

Half? What sort of dream world do you live in? There are charts outlining how much support a non-custodial parent must pay, based on province of residence, income and the number of children. I don't think anyone is paying anywhere close to half.

Feel free to prove me wrong though.

Sure will, here ya go.

"Yemchuk v. Yemchuk, [2005] B.C.J. No. 1748, 2005 BCCA 406 (B.C.C.A.)(Prowse J.A.)
Married 35 years, one grown child, husband 63 at trial, wife 61.
Family assets divided equally, trial judge found no entitlement to spousal support
Entitlement found on appeal, both compensatory and non-compensatory grounds
Engineer husband retired early in 1997, as wife transferred to Manitoba in federal government
No issue as to duration, as husband only claiming support until wife retired at 65
Husband ‘s income $37,600, wife makes $75,000

Guidelines range under without child support formula: $1,190 to $1,580
Guidelines “a useful tool to assist judges”, “intended to reflect the current law” citing W. v. W.
Extensive discussion of Guidelines issues, not evidence but part of counsels’ submissions
Support fixed at $1,100, to reflect wife’s “expenses relating to employment (including clothing, transportation expenses and significant compulsory employee deductions)”

Tedham v. Tedham, [2005] B.C.J. No. 2186, 2005 BCCA 502 (B.C.C.A.)(Prowse J.A.)
Married 16 years, wife now 52 (47 at separation), husband now 47, traditional marriage
Two children, 20 and 21, “deemed independent”, direct support from husband
Wife earns $25,000 part-time retail, income imputed of $30,000
Husband estimated to earn $343,000 in computer software sales
Payment by husband of $95,850 to reapportion property
Was paying $1,589 child support and $4,000 spousal to wife
Chambers judge ordered dimishing time-limited support for 3 more years
$6,000/mo. year 1, $4,000 year 2, $2,000 year 3, then zero, to encourage self-sufficiency
No time limit, only partial compensation, indefinite order substituted, subject to
review if husband’s medical condition (legal blindness) interferes with income
Amount fixed at $6,000, Guidelines range stated as $6,300 to $8,500 for 8 to 16 years
Lower than range because of reapportionment order
(Without child support range: $6,260-$8,347, if incomes as stated)
[Custodial payor formula range (no child support from wife): $4,712-$6,283]"

I did a lot of volunteering, which looks darned good on my resume and helped get me at least 2 jobs and serious consideration (and an offer) for a 3rd.

That was your choice, you could have used that time to better prepare yourself for something like this just in case. Now we should pay becuase of the choices you made?

lily lily:

In the first case, she should have paid him support, since she makes more.

In the second... good lord, I AM stupid.

I think I need to call my lawyer. :D

So in some cases people are paying almost half of there cheque then I guess you could say?

I would have no problme handing over 3/4 of my cheque, assuming he missus got custody, which I expect she would, since I like to beat my children and encourage loud burping at teh dinner table.

Although, if I was getting a divorce, I might not feel so magnanimous. I'd probably hide all my money in a foreign bank account and stalk her.

No, now HE should pay because of the choices WE made.

Ok if "WE" made the choices why is "HE" paying?. did he force you not to read a book on your own time?. Did he stop your from learning online?. Did he stop your from learning period?

lily lily:
Those cases are the exception, not the rule.

They are not the exception, do you want me to list the other 20 or so I happen to have on hand.

Usually all the happy wishes of support get washed away soon after the proceedings start. I have a number of friends who practice family law and very rarely do any of them go well. In most cases if they could get along while splitting finances and support, they probably wouldn’t get divorced in the first place. Bitterness and entitlement are what drives a messy divorce. And from what I hear, toss in a loosy goosy custody schedule for holidays like Christmas and you end up with a real shit show and another bill from the lawyers.

Hey… you can’t go wrong with beating your children and encouraging loud burping at the dinner table either. Your last point about tucking away a few bucks off shore is a great idea too. As far as stalking goes......in my dad’s day they called in romantic.

Yeah, and then she'd go all Farrah Fawcett on you, lock you in the fireplace, spray some Raid in your eyes, and poke you with knives and sticks, or something. Or she'd really go mental and after you've passed out after drinking your daily 40-pounder of Jack Daniels she'd douse the bed you're on with kerosene and throw a Zippo (har!) lighter at you. I saw these things on TV so they must be true.

Don't piss off the kitteh, sunshine. I got freaked out enough with my last one when I woke up in the middle of the night and found her wide-eyed staring at me for some reason. Brrrrr! Talk about your classic spooky wang-shrivelling moment or what.

Stung like the dickens, but it was better than coming home one day and finding out she had eaten all my food. Now that really sucked.

That sounds like me!

We split assets fairly evenly, based on what we wanted rather than how much anything was worth. On paper we share custody, but the kids live with me and spend some of the long weekends with their Dad. We don't have a formal visitation agreement written up, and that's how I want it. So far we've divided up holidays pretty evenly and we've been respectful and co-operative. We actually get along better now than before.

I don't understand why everyone can't be like me.

Then there must not have been a feeling of entitlement then.

From what I've heard that's what drives both camps crazy. The "He owes me because" camp and the "She can get off her ass and work" camp. Somewhere in the middle is where they end up after the lawyer bills come in.
