The only major issue I have with the judges ruling is this:

Why is all of her actions excused because an arrest was made in error? This includes her actions well after the event, as well as those during the arrest.

Also, if all of her actions are excused, why aren't all of his?

Canadian society needs to have a very serious discussion about this sort of dissonance.

If the arrest is illegal, then everything derived from it is null and void. Resisting an illegal arrest is also a duty of law abiding citizens (even if she didn't know at the time the arrest was illegal).

Section 24(2) of the Charter of Rights:

"Where a court concludes that evidence was obtained in a manner that infringed or denied any rights or freedoms guaranteed by this Charter, the evidence shall be excluded if it is established that, having regard to all the circumstances, the admission of it in the proceedings would bring the administration of justice into disrepute."

You guys do realize there are pending cases between Behiels and Tibu, and that this judge's ruling just threw out the only actual evidence of the incident...

Like Shep and me agreed a long time ago when this story first hit the news the cop should have let the spastic cumb dunt run out into the middle of the highway and get smoked by a passing big-rig. Wouldn't have had to talk about it then, or now, with people who think she's actually some kind of a victim, if an 18-wheeled solution had happened. Stupid should hurt, as the old sig line goes, and this one deserved to hurt more than most. :evil:

Civil cases. whole different ball game and this judges ruling has nothing to do with those. Although the cop's civil case isn't helped by this ruling. Presumably he's suing her for defamation, making false allegations - that shouldn't be impacted by this ruling at all.
