Which means he was in custody for 2-1/2 years prior to trial and credited with 5. So long as the judge increases the total sentence accordingly that's okay.

The maximum is 10, out in 6 with parole and supervision. This guy's gonna do 5 plus 3. Six of one thing, half a dozen of the other.

The Tories want to do away with the double time credit which even now, I believe, is at the judge's discretion.

Boo Fucking hoo, I for one am tired of excusing rape because the perp was an abused child. 20 years min should be for rape, like Murder it's a crime tha effects the victim for the rest of their life, we are too lax on criminals of all sort.

I agree, hell, I'll go one step farther: this should be an automatic life-sentence, no change of parole. But given the law the way it is, he's getting pretty much the maximum. The "double-time" credit is just smoke and mirrors; nothing to get upset about.

All remand prisoners in Ontario are given double time served credits, I do believe it's similar in most provinces.
How ever long you are in a remand facility, at sentencing the time you have already been in custody (often referred to as ‘dead’ time) is doubled and that portion is taken off the actual sentence.

The recently convicted terrorist Saad Khalid was given 7 years credit off his 14 year term for ‘dead’ time served. With Corrections Canada's rules applied, this would be bomber could be out in 2 years.

Corrections Canada are mandated to release an inmate after two thirds of a sentence is served. The prisoner is then put under the supervision of a parole officer.

So in the case of this rapist, a 7 year sentence is already reduced to 2 because of ‘dead time’. He is already into the two-thirds mark. After six more months he can apply for day parole and full parole by Corrections Canada’s own rules.

A 7 year sentence could mean that this guy will be walking the streets, albeit under the ‘supervision’ of a Parole officer, in six months time.

Not smoke and mirrors Lemmy, the unpalatable facts of our justice system.
