Scape Scape: So its less partisan, big whoop! It may do a good job of representing women on the Supreme Court, but it does a shitty job of representing the actual racial makeup of the country today. Nine white people dressed up as Santa Clause might have represented Canada fairly accurately 100 years ago, but its way, way off today. Now I am not saying that you have to rush out and stack the court with totally unqualified people just to meet some racial quota. I am saying that Canada is one of the most racially diverse places on the planet. You cannot tell me with a straight face that there are not qualified minority people who are able and willing to serve on the Supreme Court. I am not buying that horseshit for one minute. The Court SHOULD closely mirror the people that they serve. You need people that have actually walked in the shoes of those being judged to reach fair decisions. Many times being partisan is a good thing. Real, actual change comes through partisan politics. Nothing changes when everyone is afraid to rock the boat. What if most Americans went along with slavery in the 1800's to keep the peace? What if everyone just went along to get along back then? Where would we be now? Sometimes you have to stir the pot. Sometimes you have to draw some lines in the sand. Partisan politics is what is reigning in police departments with their dealings with minorities in the U.S. today. Partisan for a lack of a better word, is a good thing.

In Canada partisanship is swapped for regionalism. Getting someone on the court from the maritimes or NWT is a real feat. The PM does not appoint either. https://www.scc-csc.ca/contact/faq/qa-qr-eng.aspx#f12The Supreme Court of Canada consists of nine judges, including the Chief Justice of Canada, who are appointed by the Governor in Council and all of whom must have been either a judge of a superior court or a member of at least ten years' standing of the bar of a province or territory. A Judge holds office during good behaviour, until he or she retires or attains the age of 75 years, but is removable for incapacity or misconduct in office before that time by the Governor General on address of the Senate and House of Commons. Of the nine, the Supreme Court Act requires that three be appointed from Quebec. Traditionally, the Governor in Council has appointed three judges from Ontario, two from the Western provinces or Northern Canada and one from the Atlantic provinces.

I’ll take the Canadian system any day over the partisan mess the states has. Our system is not perfect, but it largely works.

The biggest weakness of the Canadian system is it panders to the whims of the most populated provinces and industries. I would take that any day over the partisan circus down south though. That's just insane. The only way they can fix it now it to just flood the court with appointment. Imagine a having 15 or 20 on the court.

What if the south went along with not owning people as property? You wouldn't have had a war that killed well over half a million people. It swings both ways.

There are also nine justices, so getting a majority decision is not based on any one opinion. The SCoC also does not write documents like the Bill of Rights or Constitution, they only use them as the measure against which the laws written by Parliament are measured.

I won't speak for others but, I'm getting tired of overzealous unelected Judges making decisions based on their own interpretations of the Charter and taking away the legal right of Gov't Parliament to make and enact laws or treaties without their approval.
A fact which, when you think about it, makes the necessity of electing politicians nothing more than window dressing to keep the serfs docile and thinking the people they vote for actually have the power to run the country. Damn people with qualifications making decisions for us! Who do they think they are, Judges? What;s next doctors who think they know what's good for us more than we do?
