If they did not have enought people to get them all out, they should have had more, it's really quite simple Yogi. They should have called in a replacement to make up for the one who called in sick, that is what I would have done. They forgot a child, that would not have happened if they replaced the sick staff member.

Maybe they did 'put out some calls' and maybe they didn't! Fact of the matter is that they had the required number of staff as set out by law. The daycare was put on probation for a month because they forgot to bring the 'portable records with them!

I thought it was because the Fire Fighters found the baby alone and alerted child services.

They left the kid behind and the risk of harm was high. I'm not a civil lawyer but I can see the argument. It doesn't matter that they were required by law to only have 2 workers there. You can still be held negligent even if you followed the letter of the law. Perverse but true.

the daycare was cleared of any wrong-doing except for 'failing to bring the portable records with them when they exited the building'. Given all the circumstances, the child was not in any danger as there was no fire.
