Fox owns Silver Surfer. Which Disney should have acquired with the fox disney merger. But it's likely too late to incorporate into the story at this point, sadly.

Actually, the film rights to Silver Surfer come part and parcel with the Fantastic Four, of which 20th Century Fox held the rights until the merger with Disney.
