I agree that there's no reason to believe they were intruding into Canadian waters. Just puzzled by why they can't do this kind of stuff back home.
Because of reciprocal agreements with the US military. We use their ranges and they use ours. The US Coast Guard doesn't have a live fire range available to them in the area, so they use ours. This not withstanding, while using our ranges they must adhere to the rules and regulations governing those ranges.
This includes a Notice to Mariners being put out by the MarPac, indicating when and where live firing excercist will be taking place. This advises mariners of the excercise and the area that is out of bounds to vessel traffic so they can avoid it.
The interesting thing is that the media never questioned why a whale watching excursion was in a live firing range during a exercise? If these companies are using people to run their boats, without the ability to read charts or monitor VHF radio's which continually broadcast such ad nauseum things like the weather and notices to mariners, then it's time for a review of the licensing requirements for whale watching operators. Forget about the whales, can you imagine the hue and cry if someone had got hurt because these people decided to operate their vessels in restricted waters?
