The question here shouldn’t be the divisive “should we try kids as adults”. It should be “how do you sentence the dangerous and psychotic mentally ill that are incurable”. Clearly these guys are insane. Whether you sentence them to 500 years in prison, or forever in a mental institution is irrelevant.
I’m no lawyer, but I believe if they are tried as being dangerously mentally ill, regardless of whether they are children or adults, they can be detained indefinitely. If they are tried as adults and convicted of first degree murder, they get 25 years.
It’s a moot point.
25 years w/o possibility of parole, but a life sentence. If they are found
not guilty by reason of a mental disorder, they can be detained until they are deemed cured. If some shrink deems then cured, they must be released. OTOH, Bernardo or Olsen will never get out. All we need is a parole system that works, and it would keep these guys in for their lives as well. I'm not holding my breath.
