$1:

A law‑enforcement officer is justified in using deadly physical force upon another person for a purpose specified in subdivision (1) of this subsection only when it is or appears to be reasonably necessary thereby:

a. To defend himself or a third person from what he reasonably believes to be the use or imminent use of deadly physical force;

b. To effect an arrest or to prevent the escape from custody of a person who he reasonably believes is attempting to escape by means of a deadly weapon, or who by his conduct or any other means indicates that he presents an imminent threat of death or serious physical injury to others unless apprehended without delay; or

c. To prevent the escape of a person from custody imposed upon him as a result of conviction for a felony.

If the car is stopped and the guy is boxed is and has no where to go than you just can't shoot the guy no matter how many people he has run over.

Now if the guy is a reasonable risk of using his vehicle to run someone over or is about to run someone over then fire away.

So it sounds like perhaps he was in the act of attempting to flee by means of a deadly weapon, or was attempting to use imminent deadly force against an officer perhaps...

Or he was just sitting there ready to give up and someone just decides to shoot him...

I'm going to wait for the inquiry, Eyebrock is right got to wait for the official report...

The "witness" stated she did not see anything that happened before or during the first shot. She witnessed the two shots that ended the whole thing.

If the cops were indeed injured and the guy tried to still escape (boxed in or not), the cops did exactly what they're supposed to do.

So far I don't see a problem with their actions.

Donny is looking at this very equitably

Police in Canada, and especially Ontario, are subject to unprecedented oversight. The SIU will be all over these guys and they will have to justify every decision they made or face criminal charges, and rightly so.
There is also the Police Act (Ontario) which holds officers to a legally enforceable code of conduct as dictated by the Provincial Legislature.
All police services in Ontario are overseen by Police service Boards that are a mix of local councillors and provincial appointees.
Police officers convicted of any police act charges are now forced to have those charges entered into evidence at court while other witnesses or defendants that have criminal convictions do not.

I'm all for accountability and civilian oversight. It's right in there with Peel's principles.

It's hardly Brazil and throw away comments from the biased and uneducated do not add to the debate.

If these guys fucked up they will be charged, and so they should. But hanging them in a court of internet public opinion isn't the way to go.

Let the SIU do their job. Another OPP officer was killed by a truck near London, Ont yesterday.
He didn't get the opportunity to defend himself.
He's dead. I'll be going to the funeral. Enough said.

oooohhh Donny Donny Donny, with all due respect, you've made yourself look very stupid by quoting AMERICAN LEGISLATION when attempting to explain when a CANADIAN police officer is permitted to use deadly force, we all know you are much better than this. Your biggest tip is the word Felony.....that word is foreign in the Canadian Legal System.

If a person has used his vehicle to strike a police officer or even attempt to strike a police officer, it is reasonable to believe that the officers life is in danger and therefor deadly force is permitted.

I do agree with you that we should wait until the SIU has completed their investigation, but from what the article says, seems to me that the police were justified.
