There's the rub. Will that apply to a much larger group who demand to be photographed wearing burkas?

It's the same damned thing. The photo is identification and if the Huts must provide an identifying photo, why wouldn't the bag ladies?

We need to draw a line sometimes and this sounds good to me. Full face pictures or no drivers licences or ID cards. Their purpose is identification and the photo is manditory.

I was lead to believe the Supreme court of Canada is the highest level of justice in Canada, superseding provincial courts. Why would moving to another province give them acceptance on a provincial level?

These matters are provincial issues rather than federal ones. Each province has differnt rules governing driver's licences. Each Hutterite colony is different too. My wife taught on a colony and they used cameras, and took pictures of each other.

It was the Alberta govt that pushed the issue on this, not the Feds. While the ruling affects all provincial governments, if (for example) Saskabush or Quebec don't demand photo ID on drivers licences given to a member of a religious minority, the Court didn't say that they now have to. If they do, however, opt to force photo ID's on their own any minority in their own provincial jurisdiction that objects is now SOL.

The Supreme Court of Canada ruled 4-3 Friday that a Hutterite community in Alberta must abide by provincial rules that make a digital photo mandatory for all new driver's licences as a way to prevent identity theft.

The case involved the Hutterian Brethren of Wilson Colony, located east of Lethbridge, Alta. The group had argued a 2003 regulation enacted by the province requiring photographs on the licences breached their charter right to freedom of religion.
The top court rejected the claim.



The federal court ruled that provincial laws applied, while the Hutterites argued the matter was a violation of their charter rights, which is a federal matter.

Nice to know that so many twists, turns and exploits can be made on our laws, Charter and courts of appeal. I'm not a lawman and still isn't clear but I appreciate your efforts on clarifying the difference between federal and provincial courts.
