I will play devils advocate here, how can someone be guilty of murder if their weapon did not cause the death? I would have thought maybe manslaughter as he was involved in the situation. But in the big picture the one who actually fired the shot has gotten away with it and the police/ prosecutor/ law are just trying to pin it on anyone so they can close this case and never look for the one truly responsible. Dont get me wrong this guy is no angel and he should be punished but he shouldnt get the Lions share of the punishment!!
According to the Canadian Criminal Code Section 21:
(1) Everyone is a party to an offence who (a) actually commits it;
(b) does or omits to do anything for the purpose of aiding an person to commit it; or
(c) abets any person in committing it
(2) Where two or more persons form an intention in common to carry out an unlawful purpose and to assist each other therein and any one of them, in carrying out the common purpose, comits an offence, each of them who knew or ought to have known that the commission of the offence would be a probable consequence of carrying out the common purpose is a party to that offence.
layman's terms, if a person is found guilty of the above it is just as good as pulling the trigger.
I do agree he deserves a 'break'.......for medical attention after he passes out from the hourly beatings...but only until he regains consciousness in order to continue the beatings
