I'm sorry but, I've got no sympathy for this guy. He's not the patriot fighting the good fight he's a shit disturbing ring knocker.

As a serving member of the military he should know that rules and regulations are meant to be followed not flaunted even if you don't personally agree with them. He should also know that there's a proper way to resolve conflict in a strata and that doesn't include running to the press because you feel like you're being picked on.

As for the strata council. Well they're a bunch of dickheads who caused this problem by not enforcing their own bylaws immediately because, if they had at the time of the infraction there'd be no problems about who got to do what.

But, Maj. Mitchell's excuse about not knowing about the rule is utter bullshit since every new homeowner is required by law to be given a complete set of their Strata Bylaws when they purchase a property. So, he either can't read which I seriously doubt or, he just didn't bother to read them and now thinks that his failure to carry out due diligence is a valid excuse to do what he wants.

If he's willing to flaunt something as simple as a stupid strata bylaw because he doesn't agree with it, what does that say about him and the question then becomes would he be willing to disregard other "minor" rules and regulations because they inconvenienced him or he didn't bother to learn about them?

If he wants to fly a Canadian Ensign off the front of his house the best thing for him or his wife to do would be to get on council and convince the other members to change the bylaw to reflect their flag flying "patriotism". Otherwise they should STFU and quit embarrassing the military by acting like paper patriots and trying to garner sympathy through the media.

One last thing. Strata Bylaws usually include an "unsightly property" bylaw which includes putting up things like flag poles on your front law so, if he thinks they have no control over his property he really should try reading those pesky bylaws included in the package that was given to him by his lawyer when he bought the house.

Believe it or not, I'm on the strata council of my condo, and in my limited experience, most often the trouble comes from one or two busybody's with too much time on their hands.

That may be but it doesn't matter if it's a busybody or an asshole who makes the complaint the councils hands are tied and they have to investigate and if warranted enforce the bylaw.

I've been on our council for 12 of the last 16 years doing everything from Bylaw enforcement to President and as the bylaws officer I never had to levy a fine in the entire 6 years I did it. The one thing I learned from doing bylaws was that people are much more responsive to a nice letter explaining which bylaw they're in violation of and how to remedy it.

Now that we're using a property management company to do the correspondence and try and ensure compliance we've had nothing but trouble. It always seems to have worked better when it was another owner who was the bearer of bad news.

As it turns out, the condo company's issue has to do with the pole, not the flag:

$1:

The company pushing a member of the military to take down a Canadian flag said it's the pole that's the problem, not the maple leaf.

Maj. Michael Mitchell has been told the flag he put up on his Ottawa home last year has to come down because his condominium board does not allow anything to be attached to the front of their homes.

The property management company said Thursday it is not about the flag, but what it hangs on.

"It's about securing a pole to the exterior, to the common elements of the unit," said Shelley Seaby with Axia Property Management.

She said residents can't alter the exterior walls because they're not their sole property.

"You can't just drill through the exterior wall of your unit, because the condominium corporation is responsible for common elements."

Rod Escayola, a lawyer who specializes in condominium law and a former member of the Canadian military, said this dispute is similar to many others because it centres around what a condo owner actually owns.

People often don't realize there is common property they don't control and that condo boards are strict about it.

"We have to make sure that owners don't in any way jeopardize that or damage that," Escayola said.

He also said not everyone is aligned about what should be displayed publicly.

"There are all sorts of good reasons to regulate that. What is patriotic to some is not to others."

Mitchell said earlier this week he planned to try to find a compromise at the next condo board meeting.



I was looking at the news yesterday, and while I can't find the link now, I think Major Mitchell was actually planning to move the flag to his yard anyway. So this story might end up with a happy ending anyway.
