You're not thinking like a "true" American now. They think: "What idiot would not leave me alone when I tell them to, hurt or not? It's my right to not want to have healthcare insurance, it is my right to do what I want, and I did not ask them to pick me off the street when I got hurt".

Yeah but it's not your street and you dont have a right to lie on it and let vultures peck out your eyeballs while everyone else walks by and tries not to look. You dont' have right to lie on the street wounded any more than you have a right to go to the bathroom on the street. The right to "do what you want" has limits, hence we have laws.

Besides, post-injury, a victim may have head trauma or may not otherwise the full extent of the seriousness of their injury. At the very least, care providers need to ensure that a patient understands the full extent of their injuries and the consquences of refusing treatment, which means at the very least, they need a medical examination when there are obvious signs of trauma. Without that minimal standard it wouldn't be long before the family of a victim sued the pants off of the paramedics and the city.

That doesn't mean they could give you a $40,000 bill, only because they want to see if you are ok.
It was pretty obvious he didn't have health care insurance. Since you are allowed to not have that, he should not be stuck with that bill.

First party injury protection (i.e. cover injuries suffered by driver aka PIP) is optional in most states. All states want you to have coverage to cover damage you cause to third parties, but to yourself it's still optional in some states. Plus it's quite possible he was riding uninsured as the article doesn't mention this.

It really is a deplorable situation since the law forced him to treatment, but at the same time no judge/jury on the planet is going to absolve the paramedics of liability for listening to the wishes of someone who just suffered a rather serious head injury. It must have been one hell of a crash considering the article shows him riding with a helmet (I assume it's his regular habit) yet he still suffered "...broken bones around his eye".



He wasn't wearing a 'full face' helmet, such as a Shoeii. The one he is shown wearing is designed only to protect the cranium. Seems that it followed thru on that point!

Were I the judge in this case, I would rule that the EMT's were obligated to take him to the hospital, thereby making the rider liable for the ambulance ride and the initial consultation at the hospital. Since the medical personnel at the hospital went ahead with treatment after the patient again voiced his wishes for no treatment, the hospital to be held liable for any further costs.

Take note: In the US refusing treatment and walking out still gets you at $40,000 bill. Imagine how much it would have been if they'd treated him. I don't know how anyone can suggest we'd be better off in that system.

The ones who usually want private health care are the wealthier members of society, who want lower taxes (fewer hypochondriac sponges leeching off the system) and the 'right' to choose their level of coverage.

Meet my Kid Brother Bruce. He's been riding Harleys for over 30 years. Owns 2 right now. One of which he just built and had certified today, coincidentally. (He's the one on the left. The other 2 are also my younger brothers, and as well also wear 'full face' helmets'.

Kind of funny isn't it, he has a Harley but no medical insurance. Priorities, Priorities. :lol: I know he said he doesn't have it because he doesn't like going to see a doctor but geezus, you'd think he'd have even a minimal insurance policy.
