unfortunately the charter applied to everyone, you can't throw it away because you don't like someone.

That being said, this is the country Canadians wanted and voted for. We are a nation heading down an unknown river with little to no ambition and growing population unrest. This is what we get for not being involved, apathetic and plain lazy with our elected officials.

From where I sit, we are getting what we deserve, a society where the criminals have more rights than we do, where fringe groups have more say in how we should act, live and our 'box' of what the government perceives as acceptable behavior is getting smaller every year.

it isn't going to get any better unless we decided to do something about it.

Like what? Get rid of it? Or appoint a panel that decides who the Charter of Rights applies to and who it doesn't?

Agreed. Though stories like this raise the ire of the common Canadian, it does not seem to bring it to the point where we infuse in our leaders, the political will to make real and substantive change. And even if that political will were there, the legal framework simply will not support the revocation of human rights. Without a doubt, a gaming console or TV aren't human rights, at least not in my book, but sleep, access to legal advice, and other tools are and if the jail messed with them, then ire should be at the jail and not the judge that's calling them on it. They should know better, especially in this day and age.

It is hard to fathom what it will take to step back from the brink, or whether we even should. It may be we, as a society, simply have to endure these little mockeries of our morals and ethics for the greater good.

You should visit a prison on Japan. They are civilized yet prisoners need to earn the right to sleep off the floor and have pillows etc. They just know what prison is supposed to be for.

As far as recording the guys phone call "by accident" :roll: Whoever did this is an idiot and they are the reason this guy might get a free pass.

He's actually innocent at the moment. He's being held so he won't escape. He would have the same rights as any other accused in that situation.

It is whining, and an interesting legal tactic that apparently has not backfired. Send a lengthy list of grivances, most of them laughably petty, but including some more serious accusations, and you present quantity over quality. Create an illusion of ongoing rights abuses over a period of months highlighted by the more serious accusations of phone call recording. Seems to be working for the guy. Hopefully, the focus will remain on the serious stuff and the nonsense gets pushed aside.

I hope the jailers/crown don't blow this case by civil rights violations. At the moment his is innocent of what he's been charged with. Like others in pre-trial lock up, he's only there to stop him from running. He is or should be given the same privileges that other people there are. Civil rights are there to protect this scumbag, so that at some point they don't come and take yours away because you've been declared a scumbag without due process.

Apparently, the prison doesn't have paper...

The judge deemed it "truly shocking" that the facility had no privacy, desks, telephones or paper to accommodate Bacon's communications with his lawyer.
