BartSimpson BartSimpson:
Keegstra absolutely deserved to be fired from his post. He absolutely did not deserve to be imprisoned.

Sorry Bart, I missed this. Keegstra wasn't imprisoned. He was fined, given probation and forced to do community service.

All About Law, 6th edition, Terry Murphy. And you're wrong, incomplete offenses do require another part of the criminal code. You can't be charged with attempting to do something that isn't listed as an offense somewhere else in the criminal code (or other source of criminal law). You'll have to qu...

Incomplete offenses are offenses that are incomplete. They are attempt, aid, abet, conspiracy and accessory after the fact. They require another part of the criminal code for conviction (ie, conspiracy to commit _____, etc). Firstly, thank you for dropping your notion that conspiracy is planning a ...

You were the one making the distinction when you said abetting was "cheering on a crime". That implied that abetting could only take place when a crime was already in progress and that's incorrect. Yes 319 is the promotion of hatred, but it's redundant because hatred is just hatred until ...

Not quite. Abetting is encouraging a crime, which is essentially what hate crimes are. If you're slicing between encouraging a crime and cheering on a crime, you're making a distinction without a difference. The wilful promotion of hatred is what S. 319 encompasses, not merely encouraging another c...

I'm not underestimating the severity, you're overestimating. The hate speech laws carry a maximum penalty of 2 years. S. 319 carries a two year max, S. 318 is 5. However, prosecutions under S. 319 are far more severe in their relation to S. 2 of the Charter, rather than something like B&E, whic...

Section 319 specifically, but also 318 and 320. I would get rid of them because I'd prefer people who are hateful to be free to identify themselves as such so I can ridicule their small-mindedness openly. I think it's a benefit to society for the crazies to have as much rope as they want to hang th...

Lemmy Lemmy:
Good stuff. Now if we could get he hate speech statute out of the Criminal Code we'd really be on to something.

Really? To which sections are you referring and why would you get rid of them?

No one's saying he deserved what he got. What they're saying is that he started the altercation and deserved some measure of retribution for snowing the goalie. There are certain things that players do that are provocation. They're done with the intention of stirring up shit, and snowing the goalie...

While it's an excellent trade for the Leafs, it makes you wonder what management's problem with Reimer was? Prior to the playoffs, they were contemplating getting busted down Kiprusoff.

Bernier is young, talented and should fit right in with the Leafs.

Why not use a more appropriate analogy? Lets say they were looking for a murder weapon. It would be appalling behaviour for a cop because it would jeopardize the evidence collected for the trial. Maybe your right and the whole thing is as silly as looking for rare action figures. There's one thing ...

Sorry to double-post, but I think if you wanted more realistic heroes, have them ride frigging bikes. Bicycles don't run out of gasoline yet outrun shambling zombies. They don't make noise that attracts them, they don't need to be outfitted Road Warrior style to upend abandoned cars on roadways beca...

I don't know if you're familiar with Toronto, but there's an AMC Theater in Dundas Square. Were your two to stumble out of that, the entire square could be full of zombies, panic and chaos. The only flaw so far is that the zombie apocalypse ever spread to Toronto streets. I know for one that I would...

But they didn't. They came looking for drugs and decided the ends justify the means. I can't tell if you're disagreeing or agreeing. My observation was the motive that resulted in a Charter breach and subsequent cover-up isn't the heart of the matter; it's the attendant obstruction of justice. How ...

Two quick comments: 1. The object of the search, the heroin, is irrelevant to the issue at hand in court, which is the illegal search and subsequent cover-up. They could have entered the residence to look for Barbie dolls and their conduct would be just as reprehensible. 2. The legality of drugs isn...
